Overview

We are looking for a Junior Legal Counsel (1 to 3 years PQE), ideally with a good understanding of online selling, marketing and advertising rules, consumer laws and data protection to work on all legal matters relating to Spain, Portugal, Brazil and Mexico.

 

Ideally, candidates would also have some experience drafting contracts (commercial and vendor agreements) under Spanish or Portuguese/Brazilian laws.  

 

This position is based in our Madrid office (Hortaleza area), and the successful candidate will be able to perform hybrid working, i.e., part-home / part-office, and be part of a team of 10 legal counsels (5 in the UK, 2 in Spain, 1 in France and 2 in the United States).

Responsibilities

Marketing and Consumer Law:

  • Reviewing marketing, ads and promotional materials, enrolment pages, T&Cs, Privacy Policies, product website pages, as well as product designs for new product launches, to check compliance with advertising rules and marketing and consumer protection laws, including data protection and e-privacy laws. Identifying key risks and working with the business to agree acceptable and compliant practices.
  • Management of consumer complaints and coordination with authorities (EU or LATAM).

Contracts:

  • Drafting and negotiating commercial and supplier agreements (advertising contracts, outsourcing agreements, distribution agreements, etc.). 

Data protection:

  • Advise on data protection matters relating to customer personal data and the proper processing of personal data.
  • Provide answers to subject access requests, handle any queries from authorities or escalated complaints.
  • Draft DPIAs and LIAs.
  • Advise on consents and permissions.

Qualifications

Candidates should be Spanish native speakers, fully qualified in Spain (1 to 3 years PQE), with experience in marketing/product reviews and handling consumer queries, ideally as well in contract drafting. If candidates are proficient in English or speak Portuguese, this will be looked upon favourably.

 

Analytical skills, attention to detail, and excellent legal writing and research skills are required for this role.
